Artists work for licence website2/17/2024 ![]() ![]() Although, this technology has over time, been irregularly deployed for the creation of the controversial ‘deepfake’ videos, they’ve paved the way for more advanced AI which can effectively recreate pictures and drawing with outstanding precision ![]() This was as a result of a ground-breaking research conducted by Ian Goodfellow in 2014 which has enabled researchers create realistically looking but computer-generated photos of people’s faces. Most of the AI artworks that have emerged over the years make use of a class of deep learning algorithms known as Generative Adversarial networks. Within the last couple of years, artists have taken AI art to a whole new level, using algorithms that learn these aesthetics and apply them by analyzing thousands of images. Over the past fifty years, artists have been using computers to generate forms of digital art, but previously had to write the code that specified a set of rules to create the perfect aesthetical piece. In order to reconcile this divergence, this article seeks to critically examine the legal issues involved in the copyrightability of AI art using a multi jurisdictional approach, citing unique challenges the situation creates and suggest possible areas of legal reform in order to deal with this eventuality that is fast becoming pervasive in our world today If the input on which a creation is based-the data-is made by someone else, shouldn’t he then be the owner of whatever work is created from it? And even if work is produced by an AI independently, can it really be classed as original? Traditionally, copyright laws from a cross-jurisdictional standpoint has always been based on a human creator who creatively, originally and independently creates a work of art from the profundity of his/her imaginations in such a way that it reflects his/her personality, ideas and belief systems. This position is valid if for example, a creative work is based on machine learning, a technique that allows an AI to learn for itself from data it was provided. AI generated artworks also raises some controversial issues by potentially encroaching on the intellectual property rights of others. Generative AI systems and the artwork they produce raise critical questions bordering on authorship, licensing, and reproductive rights amongst others stemming from general policy concerns to the individual interest of the artist involved in the creation of the work. ![]() The creation of any given work of art by an Artificial Intelligence system has always been a source of debate among relevant stakeholders. ![]()
